Understanding Religious Harassment in the Workplace

Religious harassment at work can occur during the hiring process, in promotion or work assignment decisions. Sometimes also in compensation matters, or during employment termination. Religious discrimination laws protect all employees with sincerely held religious beliefs, regardless of their religion.

Title VII of the Civil Rights Act of 1964, which applies to employers with at least 15 employees, includes strict prohibitions against religious discrimination. In addition, the Massachusetts Fair Employment Practices Act (FEPA) includes protections against religious discrimination. FEPA applies to employers with six or more employees, but also specifically requires employees to provide at least 10 days of notice to employers when they will miss work for their creed or religion and allows employers to require employees to make up missed time.
